DMCA Notice and Takedown Policy

We take copyright infringement seriously and comply fully with the provisions of the Digital Millennium Copyright Act (“DMCA”). When we receive a valid DMCA takedown notice, we act promptly to remove or disable access to the material alleged to infringe upon a copyright owner’s rights. This process is designed to respect the rights of copyright holders while also preserving the rights of users and alleged infringers under applicable laws.

Upon receiving your DMCA notification, please be aware that we are legally obligated to forward your notice, including your contact information, to the party who uploaded or posted the content in question. This disclosure is intended to facilitate an amicable resolution and to ensure transparency and fairness in the enforcement process.

Submitting a Valid DMCA Notice

To submit a valid DMCA notice, your communication must include all of the following elements:

• A detailed description of the copyrighted work that you claim has been infringed.
• Identification of the precise location on our website (such as the specific URL) where the allegedly infringing content is found.
• Your contact information, including your full name, physical mailing address, telephone number, and a valid email address.
• A good faith belief statement that the use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
• A statement that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner, made under penalty of perjury.
• Your physical or electronic signature, which can be your typed name if sent via electronic means.

Once we process a proper DMCA takedown notice, we will remove or disable access to the material alleged to be infringing. However, the individual or entity whose material has been removed or disabled has the right under the DMCA to submit a counter-notification if they believe the removal was in error or due to misidentification.

Submitting a Counter-Notification

A valid counter-notification must contain the following information:

• Identification of the material that was removed or disabled and the location where it appeared before removal.
• Your contact information, including full legal name, address, telephone number, and email address.
• A statement, under penalty of perjury, that you have a good faith belief that the content was removed or disabled as a result of mistake or misidentification.
• A statement consenting to the jurisdiction of the Federal District Court for the judicial district where your address is located. If you reside outside the United States, consent to jurisdiction in any judicial district where our service provider is located.
• A statement agreeing to accept service of process from the person who provided the original DMCA notice or an agent of such person.
• Your physical or electronic signature.

Upon receipt of a valid counter-notification, we will forward the information to the original complainant. Unless the original complainant files a lawsuit seeking a court order to restrain the alleged infringing activity within 10 to 14 business days, we will restore the removed material.

It is important to understand that misuse of the DMCA process, including submitting false or fraudulent takedown requests or counter-notifications, may lead to severe penalties under federal law, including liability for damages, costs, and attorney’s fees.
